Prosecution/Claims History
In the world of intellectual property, the claims history of a patent holds immense value. It provides a wealth of information regarding the examiner's reasons for rejection, the applicant's replies, and the subsequent claim amendments. This information can provide valuable insight by helping you to:
-
Invalidate a patent, by helping you understand and judge the stability of the patent from the previous review process
- Potentially helping you find an effective entry point for a patent of your own
- Approval of your own patent, by learning from the responses and revision strategies of similar patents in the face of similar rejection reasons, to increase the probability of patent authorization
- Check the process of modifying the competitor’s claims, and you can judge which rights are waived by the opponent
You can view a patents claims history in the file wrapper tab of patent. This feature is only available for US patents, and have at least one rejection file in the file wrapper.
Once you enter the claims history, you will see a timeline of the rounds of rejection in the top left hand corner. You can toggle between the different rounds of rejections by clicking on the timeline.
By default, for each round of rejection, two columns are displayed. The left column is the notification of rejection, and the right column displays the amendments. If there is no amendments, then the reply notice will be displayed instead.
The amendments are highlighted in green and red, with green being new text added in and red being text which has been removed.
Additionally, for the amendments file, you can toggle between a PDF and text file depending on your preference of view.
