Best workflow for invalidity searches
Hi,
I am looking to use PatSnap Analytics to find prior art I can use to invalidate existing patents. Could someone share with me the optimal workflow to collect the most comprehensive prior art that could be used to invalidate an existing patent?
Thanks
Jan

Hi Jan,
Thanks for posting in the Community!
When it comes to invalidating patents, it's key to remember that prior art from any source can be used.
In Patsnap Analytics, the main 2 data types to consider are patents and literature.
For patents, we have the following guide that advises on how to build a FTO search: https://help-patsnap-com.sutd.idm.oclc.org/hc/en-us/community/posts/11981259412765-Freedom-to-Operate-Search. If you ignore the specifying of authorities and legal statuses, you can do the same method for an invalidity search.
For literature, you can do similar but the key focus will be on building a high quality technology search query.
We also have the following article which discusses the differences between FTO and patentability (what you are trying to disprove with an invalidity search): https://help-patsnap-com.sutd.idm.oclc.org/hc/en-us/articles/360005529058-Patentability-vs-Freedom-to-Operate.
